David M. Shearer

Veteran trial attorney David M. Shearer has won multi-million-dollar awards on behalf of his clients. An expert in personal-injury cases, he brought suit on behalf of a 24-year-old New York resident who suffered facial injuries in a car accident. The trial resulted in a $1.9 million verdict for his client.

David M. Shearer also has successfully tried or negotiated dozens of medical-malpractice cases. Notably, he secured awards totaling $280 million for children who received improper medical treatment at birth or whose mothers received improper care during delivery. For one child, who suffered brain injuries during treatment, Mr. Shearer negotiated a $64-million settlement. The funds will support the boy for the rest of his life.

Mr. Shearer has litigated many other medical-malpractice suits. He secured an $8.1-million verdict for a Bronx man who was given an incorrect amount of medication and had to have both hips replaced. He also has won judgments for those injured during cataract and knee-replacement surgeries.

A graduate of the Boston University School of Law in Massachusetts, David M. Shearer spent the early stage of his career with Bower & Gardner in New York. He remained there as a Trial Attorney for five years. In 1992, he joined another New York firm, Sullivan & Liapakis. He served as an attorney there for two years before leaving to start his own practice.

For the last 18 years, David M. Shearer has performed as founding partner of Shearer & Essner, LLP, in New York City.
