In 2005 my ex had my child supports payments transferred from Ohio to Florida. We began making those payments to Florida. Almost a year into this, we discovered that although the checks were being cashed by Florida Child Support, they were simply placed in a Kitty instead of forwarding over to Ohio Child Support. As most non-custodial parents or "Payers" as Child Support likes to view us, we don't communicate with the Custodial Parent due to Parental Alienation issues. The only thing I tracked was that the payments were taken out of the bank account. We discovered that six payments weren't transferred when we received a letter from Clermont County Court stating that there was a hearing and that if I didn't present myself in court, the judge would place a bench warrant out for my arrest. Mind you, I live in Florida. I was required to present myself to prison Sunday night for a hearing on Monday before I can even present proof of payments and prove my innocence. I hired an attorney and drove to OHIO. In court, I tried to explain that we made the payments to FL, provided the evidence, however, the Judge McBride already had his mind made up and predetermined that he wanted me to accept the Diversion Program. He did not want this going to trial as relayed by my attorney at the time. Basically, Judge Jerry McBride did not care that it was an error and stated that it was my job to follow the money trail. Because Florida failed to process my payments accordingly, my family paid the price.
I have paid more than $58,000 in child support in three years on the Diversion program, but I ended up behind bars and convicted with three counts of felonies because of a "perfect storm" of events:
