Mark Flagel

An accomplished academic and attorney, Mark Flagel has distinguished himself as one of California’s leading litigators and intellectual property lawyers. His top-notch legal representation and cutting-edge grasp of developments in patent law have placed him on numerous lists of leading attorneys. Mark Flagel has litigated many cases in all areas of intellectual property law, including trademark, unfair competition, copyright, and patent law. As counsel for Stac Electronics, Mark Flagel was a memberof the team that successfully sued software colossus Microsoft for infringement of his client’s patent, resulting in a jury verdict of $120 million. In another major patent infringement suit, Mark Flagel successfully defended Monolithic Power Systems, Inc. at trial against unmeritorious claims of patent infringement. In a subesquent lawsuit brought by the same company, the opposing party ultimately dismissed their own claims, with prejudice. Mark Flagel graduated magna cum laude from the University of California, Los Angeles, with a Bachelor’s degree in Political Science. He then attended the nationally ranked Boalt Hall School of Law at the University of California, Berkeley, graduating in the top 10 percent of his class and as a member of the elite Order of the Coif. He sits on the Executive and Planning Committees of the University of Southern California Intellectual Property Institute and has served as an Adjunct Professor at Loyola Law School Los Angeles. Mark Flagel has spoken at numerous conferences regarding intellectual property issues and authors articles on recent developments in the law. Two pieces that Mark Flagel recently co-authored, available on the Lathan & Watkins LLP website, are entitled “Federal Circuit Rules that False Marketing Statute Requires Penalties Per Article,” and “The Law of Patent Damages: Who Will Have the Final Say?” Southern California Super Lawyers named Mark Flagel as one of the region’s top attorneys six times, most recently in 2010. In addition, he was named as one of 75 leading litigators by the Los Angeles Daily Journal and received mention in the Los Angeles Business Journal’s “Who’s Who in Law” feature.
